A Title Examination is an analysis of the title search and the instruments contained therein (and sometimes other title evidence), assessing the correctness & sufficiency of the instruments to determine who owns the property, what outstanding mortgages, liens, unpaid taxes, and judgements against the seller affect the title to the property, and any action required to pass good, marketable record title. Many title defects cannot be discovered by the Title Examiner because they have never been recorded and therefore are not part of the Title Search. Title Insurance protects against that hidden risk and many others.
